Dog Bites
Dog bites are dangerous, painful and costly injuries. The
chances of being bitten by a dog in America are increasing
each year. A domestic pet that is not properly trained, goes
unsupervised, or whose characteristics are not known by its
owner may result in serious permanent injuries to the victim
of a bite. The physical injury, and even disfigurement caused
by an animal bite may be secondary to the mental injury of a
bite victim. It is not uncommon for a child victim of a
vicious animal attack to suffer post-traumatic stress disorder
and to require psychological care for an extended period of
time.
When evaluating potential liability for a dog bite lawsuit,
the following matters should be considered:
- Most municipalities have ordinances requiring the
restraint and supervision of dogs and dangerous animals
- The owner of a dog or animal may be strictly liable for
damages resulting from animal bite that occurs off its
owner's property
- The owner of a dog or animal shown to be a prior danger
is strictly liable for any injury caused by the dog or
animal, even on its owner's property.
